Terms of Service

By creating an account or using GuestToPhone ("the Service"), you agree to these Terms of Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these terms.

GuestToPhone is a SaaS platform that allows hotels and accommodation providers to import guest reservation data and sync guest contact information to staff mobile devices via the CardDAV protocol.

You agree not to:

• Upload personal data without a lawful basis under applicable data protection law
• Use the Service to contact guests for unsolicited commercial communications
• Attempt to reverse-engineer, scrape or exploit the Service
• Share your account credentials with third parties not bound by these Terms
• Upload data relating to persons under 16 years of age

You are the data controller for all guest personal data you upload. You are responsible for:

• Having a valid legal basis for processing guest data
• Informing guests of the processing in your privacy notice
• Responding to guest data subject requests
• Complying with applicable data protection laws (GDPR, etc.)

GuestToPhone processes data on your behalf as a data processor (Article 28 GDPR). A Data Processing Agreement is available on request at [email protected].

We aim for 99% uptime but provide the Service "as is" without a formal SLA at this stage. We will notify you of planned maintenance at least 24 hours in advance. We are not liable for downtime beyond our reasonable control.

All rights in the GuestToPhone platform remain with the operator. You retain all rights to data you upload. You grant us a limited licence to process that data to provide the Service.

You may cancel your account at any time from the dashboard. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

To the maximum extent permitted by law, GuestToPhone's total liability for any claim is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, consequential or punitive damages.

These Terms are governed by Czech law. Any disputes shall be subject to the exclusive jurisdiction of Czech courts.

We may update these Terms from time to time. We will notify you by email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
